Law Enforcement and Government Demands Policy

Introduction

DonateDirectly, Inc. and its subsidiaries and affiliates (collectively, “DD”) are committed to upholding the privacy of its users and employees (collectively, "Data Subjects") while complying with applicable U.S. laws and privacy regulations. DD also cooperates with legally valid court orders, subpoenas, search warrants, or other requests issued by law enforcement or government agencies (collectively "Requests"). This policy outlines the principles DD follows when responding to such Requests.

This Policy provides guidance to law enforcement officials and government representatives (“You” or “Your”) regarding the legal process DD requires for disclosing Data Subjects information. It is not intended for requests from DD users, civil litigants, or criminal defendants. Civil litigants and criminal defendants can submit such requests via info@donatedirectly.com, and DD users can access their data by emailing info@donatedirectly.com.

(2) General Information

Data Subject information is managed in accordance with DD’s Privacy Notice and Terms of Use. As outlined in our Privacy Notice, we may transfer, disclose, or retain Data Subject information in response to legal requests by courts, law enforcement, public authorities, tax authorities, or other authorized entities when required by law. Such disclosure may occur when necessary to:

  • Fulfill legal obligations;
  • Comply with valid legal requests (such as subpoenas or court orders);
  • Address criminal investigations or suspected illegal activity;
  • Enforce our Terms of Use or other policies;
  • Protect the rights, property, or personal safety of DD, its employees, users, or the public.

DD uses a centralized system for receiving, processing, and responding to law enforcement and government requests. All requests are reviewed by our legal team, and those deemed legally invalid, unclear, overbroad, or inappropriate may be objected to, challenged, or denied.

This Policy does not create any enforceable rights against DD, and DD reserves the right to update or amend this Policy at any time without notice. The latest version will always be available on the DD website.

(3) Information Available from DD

This section outlines the general types of information DD can provide in response to a valid Request:

  • Name, email address, IP address, and phone number associated with a fundraiser organizer or user;
  • Fundraiser content, including historical versions or edits;
  • Details regarding the amount of money raised by a specific fundraiser;
  • Information about fund withdrawals, including dates and amounts;
  • Name, email address, IP address, donation amount, and date of donation for donors;
  • Third-party payment processor details relevant to the fundraiser.

DD may limit, redact, or minimize the information provided to comply with legal requirements or protect privacy.

Please note: DD is not a financial institution or payment processor and does not hold user banking information, credit card details, or other financial records. For such details, please contact the relevant third-party payment processor.

(4) Guidelines for Requesting Information from DD

Law enforcement or government agencies must be specific in their Requests to avoid misinterpretation or rejection. Requests should include the legal basis, citing the applicable U.S. law authorizing the collection of information from a third party like DD. Overbroad, vague, or otherwise inappropriate Requests may be rejected. Requests should clearly identify the user or fundraiser in question, including details such as:

  • Fundraiser title;
  • Fundraiser link;
  • Full name of the user;
  • User’s email address.

Names alone are often insufficient, and DD cannot conduct searches using dates of birth, social security numbers, or bank account details.

United States and other countries: Requests can be submitted via info@donatedirectly.com, provided they come from an official law enforcement email account.

Other jurisdictions: Law enforcement agencies outside of the U.S. should utilize mutual legal assistance treaties (MLATs), the Hague Evidence Convention, or other comparable legal mechanisms.

Witness Testimony: DD does not accept service for witness testimony via electronic means. Requests for witness testimony must be formally served on DD’s registered agent and properly domesticated under U.S. law. DD will resist testimony Requests served with less than 14 days’ notice.

(5) Exigent Circumstances Procedures

Exigent Circumstances involve imminent threats of death, serious injury, terrorism, or similar emergencies. In these cases, DD may disclose information without the need for a subpoena, search warrant, or court order. To demonstrate such circumstances, the requesting agency must verify their identity and the nature of the emergency.

Requests under Exigent Circumstances may be submitted via info@donatedirectly.com. DD will assess the request and verify its validity before providing any necessary information. Only the data needed to address the emergency will be disclosed.
